These Terms & Conditions ('Terms') govern your access to and use of the Nyxen Media website and services. By using our site or engaging us for services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Services
Nyxen Media provides website design and development, SEO, paid media, social media marketing, content and email marketing, and branding and creative services, as described on our Services page. The specific scope, deliverables, timeline and fees for any engagement will be set out in a separate signed proposal or statement of work, which takes precedence over these general Terms.
Client Responsibilities
- Provide timely feedback, approvals and access to accounts, assets or systems needed to complete the work.
- Ensure any content, trademarks or materials you provide to us do not infringe on third-party rights.
- Make payments according to the schedule agreed in your proposal or contract.
Payment Terms
Unless otherwise agreed in writing, invoices are due within 14 days of receipt. Late payments may result in a pause of active work until the account is brought current. Recurring marketing retainers are billed monthly in advance.
Intellectual Property
Upon full payment, final website files and creative deliverables become the property of the client, except for any third-party licensed assets (stock photography, fonts, plugins) which remain subject to their original license terms. Nyxen Media retains the right to display completed work in its own portfolio and marketing materials unless otherwise agreed in writing.
Cancellation & Termination
Either party may terminate an ongoing engagement with 30 days' written notice. Work completed and expenses incurred up to the termination date remain payable. Deposits for project-based work are generally non-refundable once work has begun.
Limitation of Liability
Nyxen Media will perform services with reasonable skill and care, but we do not guarantee specific business outcomes such as search rankings, traffic volumes or revenue figures, as these depend on factors outside our control. To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim.
Changes to These Terms
We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
